By using OdysseyApex.com or purchasing our services, you agree to these Terms of Service. If you disagree, do not use our services.

2. Services Provided

Odyssey Apex generates and sells exclusive leads to contractors in Jupiter, Vero Beach, Stuart, and surrounding Treasure Coast areas.

We provide:

  • Lead generation via our owned and operated websites

  • Exclusive leads (sent to only ONE contractor per service per city)

  • Lead notifications via email and SMS

  • Monthly performance reports

We do NOT provide:

  • Guaranteed number of leads (varies by season, service, location)

  • Lead quality guarantees (we qualify leads but cannot control homeowner behavior)

  • Business advice, legal counsel, or contractor services

3. Eligibility

To use our services, you must:

  • Be at least 18 years old

  • Operate a legitimate, licensed contracting business

  • Be based in our service area (Jupiter, Vero Beach, Stuart, Treasure Coast)

  • Have appropriate business insurance and licensing

4. Pricing and Payment

Payment Models:

Option A: Pay Per Lead

  • $150-$250 per qualified lead (varies by industry)

  • Invoiced weekly or monthly

  • Payment due within 7 days of invoice

Option B: Monthly Retainer

  • $1,000-$1,500/month (varies by industry)

  • Billed on the 1st of each month

  • Includes 5-10 guaranteed leads per month

Option C: Revenue Share

  • 10-15% of closed jobs from our leads

  • Paid within 30 days of job completion

  • Requires monthly sales reporting

All payments processed via Stripe, PayPal, or bank transfer.

5. What Counts as a "Qualified Lead"

A qualified lead includes:

  • Homeowner (not renter)

  • Within your service area

  • Project matches your services

  • Provides name, phone number, and project details

Unqualified leads (wrong area, spam, duplicate) are not charged.

6. Lead Exclusivity

We only partner with ONE contractor per service per city. Your leads are exclusive to you and will not be shared with competitors.

7. Contractor Responsibilities

You agree to:

  • Respond to leads within 24 hours

  • Provide quality service to customers

  • Report any lead quality issues within 48 hours

  • Pay invoices on time

  • Maintain proper licensing and insurance

8. 30-Day Trial Period

New clients receive 5 free leads over 2-4 weeks. After the trial:

  • You may continue with paid service

  • You may cancel with no fees owed

  • Trial leads remain yours (no refund or clawback)

9. Cancellation Policy

Pay Per Lead: Cancel anytime, no fees. Outstanding invoices still due.

Monthly Retainer: 30-day notice required. Final month prorated if applicable.

Revenue Share: 90-day notice required. Revenue share owed on all jobs from our leads, even after cancellation.

10. Refunds

We do not offer refunds for:

  • Leads you chose not to follow up on

  • Leads you did not close

  • Seasonal fluctuations in lead volume

We DO offer credits or refunds for:

  • Unqualified leads (reported within 48 hours)

  • System errors on our end

  • Duplicate leads

11. Limitation of Liability

Odyssey Apex is not liable for:

  • Lost business or revenue from leads

  • Homeowner disputes or non-payment

  • Seasonal fluctuations in lead volume

  • Third-party website or tool failures

  • Your business operations or legal compliance

Maximum liability: Amount paid in the last 30 days.

12. Intellectual Property

All websites, content, and marketing materials created by Odyssey Apex remain our property. You receive leads only, not ownership of websites or marketing assets.

13. Confidentiality

Both parties agree not to share:

  • Pricing details

  • Lead generation methods

  • Business strategies or trade secrets

14. Termination

We reserve the right to terminate service if you:

  • Fail to pay invoices

  • Provide poor service that damages our reputation

  • Violate these terms

  • Engage in fraud or misrepresentation

15. Dispute Resolution

Disputes will be resolved through:

  1. Good-faith negotiation

  2. Mediation (if needed)

  3. Binding arbitration in Florida (if mediation fails)

You waive the right to class-action lawsuits.

16. Changes to Terms

We may update these terms with 30 days notice. Continued use of services constitutes acceptance.

These terms are governed by Florida state law.
